FinalApp Terms of Service

These Terms & Conditions explain the commitments we make to you—and the commitments you make to us—when you rely on FinalApp to accelerate your job search.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FinalApp platform, including our website, mobile applications, browser extensions, APIs, AI agents, and related services (collectively, the "Service").

The Service is operated by FinalApp, Inc., a Delaware corporation, with a principal place of business in Newark, Delaware ("FinalApp," "we," "us," or "our").

IMPORTANT NOTICE REGARDING ARBITRATION: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ SECTION 15 CAREFULLY.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2. Scope of the Service

FinalApp provides tools designed to assist users with:

  • Creating, editing, and managing resumes and related application materials;
  • Generating AI-assisted content such as resumes, cover letters, and outreach messages; and
  • Where expressly enabled by the user, automating the submission of job applications and related communications using AI-powered agents.

Note: FinalApp is not an employer, recruiter, staffing agency, or employment agency and does not guarantee interviews, job offers, employment, compensation, visa sponsorship, or any other outcome.

3. Account Registration and Security

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are solely responsible for all activity occurring under your account, whether authorized or not.

4. User Authorization; Limited Agency Relationship

When you enable automated application or outreach features, you expressly authorize FinalApp to act as your limited agent solely for the purpose of submitting job applications and related communications in accordance with your instructions, configurations, and approvals.

You acknowledge and agree that:

  • FinalApp acts only as a technical intermediary executing your instructions;
  • You retain full responsibility for the content, accuracy, and legality of all submitted materials; and
  • FinalApp does not independently verify employer requirements, job board rules, or platform policies.

You may disable automation features at any time through your account settings.

5. AI-Generated Content and Automation Risks

You acknowledge and agree that:

  • AI-generated content may contain inaccuracies, omissions, or unintended language;
  • FinalApp does not guarantee that AI-generated materials are accurate, complete, or suitable for any particular role;
  • Employers, job boards, and applicant tracking systems may reject, filter, delay, flag, or block submissions; and
  • Automated submissions may fail due to third-party technical limitations or policy restrictions.

FINALAPP DISCLAIMS ALL RESPONSIBILITY FOR EMPLOYER DECISIONS, PLATFORM BEHAVIOR, OR THIRD-PARTY OUTCOMES.

6. User Content

You retain ownership of resumes, cover letters, credentials, and other content you submit ("User Content").

You grant FinalApp a non-exclusive, worldwide, royalty-free license to host, process, transmit, reproduce, and use User Content solely to provide, operate, and improve the Service, including submitting applications at your direction. This license terminates upon deletion of your account, subject to legal retention requirements and system backups.

7. Prohibited Uses

You agree not to:

  • Submit false, misleading, or unlawful information;
  • Impersonate any person or entity;
  • Use the Service to violate employer, platform, or job board terms;
  • Interfere with or disrupt the Service or its security mechanisms; or
  • Use the Service for unlawful discrimination or harassment.

FinalApp reserves the right to suspend or terminate accounts for violations.

8. Fees, Billing, and Subscriptions

Certain features require payment. Pricing and billing terms are disclosed at the time of purchase. Unless otherwise stated in writing, all fees are non-refundable, except as required by law. Cancelling a subscription stops future charges but does not entitle you to a refund for any unused period.

9. Third-Party Services

The Service may interact with third-party websites, job boards, employers, AI model providers, analytics services, and payment processors ("Third-Party Services").

FinalApp does not control and is not responsible for Third-Party Services, their availability, content, policies, or practices. Your use of Third-Party Services is governed by their respective terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINALAPP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • FINALAPP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; AND
  • FINALAPP'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO FINALAPP IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless FinalApp and its affiliates from any claims arising out of:

  • Your User Content;
  • Automated submissions made at your direction;
  • Your violation of these Terms or applicable law; or
  • Your violation of third-party rights or platform rules.

13. Termination

You may terminate your account at any time. FinalApp may suspend or terminate access immediately, without notice, if we reasonably believe you have violated these Terms, misused automation features, or exposed FinalApp to legal or reputational risk. Upon termination, your right to use the Service ceases immediately.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

15. Arbitration Agreement and Class Action Waiver

a. Mandatory Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under the Federal Arbitration Act.

b. Class Action Waiver

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY, AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

c. Opt-Out

You may opt out of arbitration by sending written notice to support@finalapp.io within 30 days of first accepting these Terms.

d. Small Claims

Either party may bring qualifying claims in small claims court.

16. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and FinalApp.
  • No Reliance: You have not relied on representations outside these Terms.
  • Severability: Invalid provisions shall be severed.
  • Assignment: You may not assign these Terms without consent; FinalApp may assign freely.
  • Waiver: Failure to enforce any provision is not a waiver.
